Pronto tendremos una nueva Ley de Propiedad Intelectual. El legislador ha tratado de identificar en el proyecto de ley las áreas más problemáticas y ofrece algunas soluciones interesantes y que apuntan en la buena dirección. Sin embargo, con cada modificación legislativa en materia de derechos de autor queda la impresión de que seguimos muy lejos de poder instrumentar un sistema que esté en consonancia con las claves del mercado en el que se mueve. Un análisis económico de algunas de la cuestiones más relevantes en materia de derechos de autor ha de hacernos reflexionar.

We will soon have a new Intellectual Property Law at our disposal. The legislator has tried to identify in the Draft Bill the most controverted areas and offers some interesting solutions that point to the right direction. However, after every legislative modification in the field of royalties we end up with the feeling that we are still far from being able to arrange a system in accordance to a market, which has its own clues, and in which it has to operate. An economic analysis of some of the most relevant items, as far as royalties are concerned, should lead us to reflection
