    The decision of the Correction Tribunal of 16 September 2019 has had a major impact because so unexpected. This decision is part of the framework for disputes relating to the removal of the portrait of the Head of State by associations environmental. Taking advantage of this decision, the judge handed down a judgment for the less surprising, applying the state of necessity to the climate emergency, and also falling within a broader debate related to the relationship between the State and the population.

    La décision du Tribunal correctionnel du 16 septembre 2019 a connu un retentissement particulièrement important tant elle semblait être inattendue. Cette décision s’inscrit dans le cadre des litiges relatifs au décrochage du portrait du chef de l’État par des associations environnementales. Profitant de cette décision, le juge lyonnais a rendu un jugement pour le moins surprenant en appliquant l’état de nécessité à l’urgence climatique, mais aussi en s’inscrivant dans un débat plus large sur les rapports entre l’État et sa population.
