Resumen de Derechos Humanos, derechos ambientales y desarrollo sostenible: la perspectiva europea

  Este artículo examina la protección del medio ambiente y aborda el desarrollo sostenible a través del prisma de la jurisprudencia del TEDH. Comienza con una breve descripción de la protección del medio ambiente en el marco del Consejo de Europa, luego, sostiene que el derecho a un medio ambiente sano está cada vez más protegido en la dinámica jurispru-dencial del TEDH. Sin embargo, y a pesar de los avances, existen importantes desafíos para la protección del medio ambiente a través de la jurisprudencia del TEDH. Estos incluyen el requisito de víctima en virtud del Convenio Europeo de Derechos Humanos, el amplio margen de apreciación generalmente otorgado a los Estados y el comprensible autocontrol del TEDH con respecto a las reparaciones una vez que se establece una violación. Si bien hay ciertos indicios de mejora, todavía hay un largo camino por recorrer para realmente lograr a una protección efectiva. En este contexto, hay una gran necesidad de que las ins-tituciones nacionales de desarrollo sostenible alcancen una protección verdaderamente eficaz del medio ambiente, complementando así la protección del TEDH.

  This chapter examines environmental protection and sustainable development through the lens of the case law of the European Court of Human Rights (ECtHR). It starts with a brief overview of the protection of the environment in the framework of the Council of Europe to then show that the right to a healthy environment is increasingly well protected in the dynamic case law of the ECtHR. Still, there are important challenges to the protection of the environment through the ECtHR’s jurisprudence. These include the victim requirement under the European Convention of Human Rights, a generally wide margin of appreciation granted to states and the ECtHR’s understandable self-restraint regarding reparations once a violation is established. While there are certain indicia of improvement there is still a long way to go. Against that background, the chapter likewise discusses the considerable need for national sustainable development institutions to achieve a truly effective protection of the environment, therewith complementing the protection of the ECtHR.
