Resumen de El municipio mexicano frente al cambio climático. Un acercamiento

A partir de dos premisas, primera, que el Estado es el responsable directo de velar por el res-peto, protección, efectividad, y en su caso, reparación de la transgresión al derecho humano a un medio ambiente sano -y con ello la efectividad de otros derechos humanos, tales como, el derecho de protección a la salud, a la alimentación, al agua, entre otros-; y, segunda, que en atención a la forma de Estado federal adoptada por el Estado mexicano, el municipio posee amplias facultades en materia de medio ambiente, desarrollo urbano, protección civil, y en el particular de nuestro interés, el cambio climático; el presente trabajo tiene como propósito reflexionar, a partir de las competencias constitucionales otorgadas a dichos niveles de gobierno en virtud de su pertenencia al sistema federal mexicano, el desempeño de estos en el combate, mitigación y adaptación al cambio climático. Lo anterior, con el propósito de apuntar algunas reflexiones y retos sobre el particular.

From two premises, first, that the State is directly responsible for ensuring respect, protection, effectiveness, and, where appropriate, reparation of the transgression of the human right to a healthy environment - and with it the effectiveness of others human rights, such as the right to protection of health, food, water, among others; and, second, that in response to the form of federal state adopted by the Mexican state, the municipality has broad powers in matters of environment, urban development, civil protection, and in particular of our interest, climate change; The purpose of this work is to reflect, based on the constitutional powers granted to that levels of government by virtue of it membership in the Mexican federal system, it performance in combat, mitigation and adaptation to climate change. The above, in order to write down some reflections and challenges on the subject.
