    The dawn of the third millennium is marked by the gradual deterritorialization of law, now conceived “as a network” and developed under varied dialogic practices. The main objective of this investigation is to contribute to a better understanding of the phenomenon of judicial dialogue and its importance in a context of multilevel protection of fundamental and human rights, in which the relationship between the various overlapping legal orders is far from being peaceful, generating, no infrequently, strong tensions and conflicts that are able to threat an effective protection of individual rights and freedoms and, pari passu, demand a greater and better dialogue. I conclude that the future of human rights and liberties passes not only, but also for an intense promotion of a greater interaction and dialogue between legal operators, thus increasing its protection at a national, supranational and universal level

    O dealbar do terceiro milénio encontra-se marcado pela gradual desterritorialização do direito, hoje concebido em rede e desenvolvido ao abrigo de práticas dialógicas diversas. O objetivo desta investigação é o de contribuir para a compreensão do fenómeno do diálogo judicial e da sua importância num contexto de proteção multinível dos direitos funda-mentais e humanos, no qual o relacionamento entre as diversas ordens jurídicas sobrepostas está longe de ser pacífico, gerando-se, não raras vezes, fortes tensões e conflitos que ameaçam a proteção efetiva dos direitos e liberdades individuais e demandam um maior e melhor diálogo. Concluímos defendendo que o futuro da jusfundamentalidade passa não só, mas também pela promoção de uma maior interação e diálogo entre operadores jurídicos, assim incrementando a sua tutela, a nível nacional, supranacional e universal.
