    A historical study of telework is carried out, reestablishing its roots from Chappe’s experience. The institute is conceptualized, aligning its essential elements and starts to comment on each of the provisions inserted by the Labor Reform of 2017 in “Chapter II-A” of the Consolidation of Labor Laws, highlighting points of change during the emergency regime established by pandemic of the Covid-19 virus. It concludes in the sense that the massive adoption of teleworking has made its weaknesses verified with this, generating movements of protective intensification in the academic and legislative environment

    Faz-se um estudo histórico sobre o teletrabalho, reestabelecendo suas raízes a partir da experiência de Chappe. Conceitua-se o instituto, alinhando seus elementos essenciais e passa-se a comentar cada um dos dispositivos inseridos pela Reforma Trabalhista de 2017 no “Capítulo II-A” da Consolidação das Leis do Trabalho, destacando pontos de alteração durante o regime emergencial estabelecido pela pandemia do vírus Covid-19. Conclui no sentido de que a adoção massiva do tele-trabalho fez verificarem-se suas fragilidades com isto gerando movimentações de acirramento protetivo no meio acadêmico e legislativo
