El ámbito de las viviendas turísticas es, en España, polémico, debido a múltiples factores. No es el menor de ellos el de la fragmentación legal existente al respecto, con abundante regulación autonómica no siempre armónica. Dentro de este ya de por sí complejo ámbito, la cesión de dichas viviendas por habitaciones es una posibilidad que merece ser atendida, como producto turístico interesante a la hora de formalizar los contratos. En la investigación que resumimos se pretende estudiar qué establecen esas regulaciones diversas al respecto, cómo se han pronunciado nuestros tribunales, en su caso, así como si el propio contrato tiene entidad y merece ser aceptado por las normas, de cara a que los particulares puedan celebrarlo.
The ambit of tourist apartaments is, in Spain, a controversial ambit, because of multiple reasons. Not the least of them is the legal fragmentation in Spain, with abundant autonomic regulations, not always harmonious. In this complex area, the transfer of these apartaments by rooms is a possibility that deserves to be addressed, as an interesting tourist product. This paper pretends to study what these various regulations establish in this question, how our courts have ruled, as well as whether the contract itself has entity and deserves to be accepted by the Law, so that individuals can celebrate it.
