    La sentencia de 11 noviembre 2020 interpreta tanto el foro exclusivo en materia de derechos reales sobre bienes inmuebles como el foro en materia contractual del art. 7.1 del Reglamento 1215/2012.

    En lo que se refiere al primero de estos foros, el Tribunal considera que es esencial, para que estemos ante un derecho real en materia inmobiliaria, que la obligación que fundamenta la acción sea oponible erga omnes. En lo que se refiere al foro contractual, es especialmente significativo que el Tribunal determine de manera directa el lugar de cumplimiento de la obligación, renunciando a remitir esa determinación a lo que establezca el derecho rector de la obligación, determinado este derecho rector por las normas de conflicto del órgano jurisdiccional que está conociendo.

    The judgment of November 11, 2020 interprets both the exclusive ground of jurisdiction in proceedings which have as their object rights in rem in immovable property and the ground of jurisdiction in matter relating to a contract of art. 7.1 of Regulation 1215/2012. Regarding the first of these forums, the Court considers that an action must be regarded as constituting an action «which has as its object rights in rem in immovable property, provided that the action may be relied erga omnes. With regard to the contractual forum, it is especially significant that the Court determines directly the place of fulfilment of the obligation; without considering the governing law of the obligation according with the conflict rules of the court seised.
