La autorización de la firma del protocolo de reclamaciones colectivas: un premio para los derechos sociales

    El 4 de febrero de 2021 España ha firmado el Protocolo de Reclamaciones Colectivas en Estrasburgo. Se está ante la muestra más comprometida con los derechos sociales que reconoce y garantiza el convenio internacional más completo existente en ese sentido, la Carta Social Europea. El origen de este acontecimiento histórico se sitúa en un año caracterizado por sufrir una de las mayores crisis a causa de la pandemia de la COVID-19 y, específicamente, en el día que más ilusión ponen los ciudadanos por el sorteo extraordinario de la lotería. Sin esperarlo, todos fueron agraciados al adoptarse el Acuerdo del Consejo de Ministros que autorizaba el inicio del trámite. Este finalizará con la ratificación o, esperemos, la emisión de una declaración específica cuando culmine el equivalente que se está desarrollando de la Constitución Social de Europa. Este comenzó de forma similar el 10 de noviembre de 2020, con la diferencia de que, al estar ya firmada, la licencia se dirigía directamente hacia la fase de ratificación, que es la única que resta. Las páginas del comentario detallan lo sucedido y prueban nuevamente la significación de este mecanismo de garantía con las últimas decisiones de fondo publicadas, con la finalidad de alejar posibles temores de los Estados, habitualmente reacios al mismo. Paralelamente, en la medida en que es complementario del sistema de informes, se facilitan las directrices a los agentes sociales y organizaciones para estimularles a presentar observaciones, tras haberse registrado recientemente el informe gubernamental.

    On 4 February 2021, Spain signed the Collective Complaints Additional Protocol in Strasbourg. This is the most committed demonstration towards social rights thus far, as it is linked to the European Social Charter, the most comprehensive international convention in this area. The origin of this historic event comes at the heels of a year characterised by one of the greatest crisis caused by the COVID-19 pandemic. Ironically, it also comes in one the most anticipated days of the year: at the eve of the Special National Christmas Lottery Draw. Without expecting it, all Spaniards won the jackpot that day, as the Agreement of the Council of Ministers, authorising the Protocol signature, was adopted. This process will end with the ratification or, hopefully, the issuing of a specific declaration when the still-ongoing and so-called Social Constitution of Europe is completed. The latter also began in a similar fashion, on 10 November 2020, with a caveat: having already been signed, it went straight to the ratification stage, which is still pending. The present commentary details the historical and legal chronology and, once again, proves the significance of this guarantee mechanism in light of the latest published substantive decisions. This paper also aims at easing State reluctance as it relates to its much-feared application. At the same time, insofar as it is complementary to the reporting system, guidelines are also provided to social actors and organisations to encourage them to submit comments, following the recent filing of the government report.
