    El artículo examina la potestad que el Código Procesal Penal le otorga a la Policía Nacional para que informe a los medios de comunicación social acerca de la identidad del imputado; y analiza si dicha facultad afecta el derecho a la presunción de inocencia que consagra la Constitución Política del Estado y el propio Código Procesal Penal, con la finalidad de demostrar que, en este aspecto, la garantía de un sistema penal democrático es nula y tiene graves efectos negativos en la persona, en términos de etiquetamiento y estigmatización para la construcción del enemigo.

    The article examines the power that the Criminal Procedure Code gives the National Police to inform the media about the identity of the accused; and analyzes if this faculty affects the right to the presumption of innocence enshrined in the Political Constitution of the State and the Code of Criminal Procedure, in order to demonstrate that, in this aspect, the guarantee of a democratic criminal system is null and has serious negative effects in the person, in terms of labeling and stigmatization for the construction of the enemy.
