Resumen de La atribución voluntaria de ganancialidad y la libertad de pactos entre los cónyuges.: Comentario a la Sentencia del TS de 12 de febrero de 2020 (RJ 2020, 374)

En el presente trabajo abordaremos el estudio relativo a la atribución de ganancialidad a un bien privativo, por los cónyuges, de común acuerdo ─a través del comentario de la STS de 12 de febrero de 2020 (RJ 2020, 374) ─ con la finalidad de comprender la posibilidad de efectuar tal atribución y el marco jurídico aplicable al supuesto. A tal efecto, será necesario comprender si la referida facultad se prevé en forma directa y clara, o entra dentro del campo de la libertad de pactos entre los cónyuges prevista en el artículo 1323 del Código civil.

In this paper we will address the assumption of the so-called “atribución de ganancialidad” (attribution of community property character) to a private property, by the spouses, by common agreement ─through the commentary of the STS 12 february 2020 (RJ 2020, 374) ─ in order to understand the possibility of such attribution and the legal framework applicable to the case. To this scope, it will be essential to understand whether this power is provided for directly and clearly, or falls within the scope of freedom of agreement between spouses provided for in article 1323 of the Spanish Civil Code.
