    En este artículo el autor reconstruye los principios básicos del ius existentiae en la Constitución italiana y en la experiencia española: el derecho a una existencia libre y decorosa, también en situación de pobreza y desempleo. El problema es que, cuando el Estado no cumple la promesa del “trabajo para todos”, tiene la obligación de garantizar a todos la existencia.

    In this article the author reconstructs the basic principles of ius existentiae in the Italian Constitution and in the Spanish experience: the right to a free and decent existence, also for persons in a situation of poverty and unemployment. The problem is that, when the State does not fulfill the promise of «work for all», it has the obligation to guarantee existence to all. And this means the subsidy route.
