    The open Appeal regarding the proposition of the evidence is the one that best adjusts to the correct immediacy and effective judicial protection of rights. There is no reason to be that since there is the possibility of detecting injuries and rights violations much earlier, the defendant is allowed to wander through numerous resources and instances, all with their shortage of time and money. A new vision of the appeal is necessary as something really essential in the development of the structural and fundamental principle and fundamental rights that is the effective judicial protection of our rights and freedoms. It is only this reading that fits the Constitution as the maximum norm, although it can be developed, it can never be in the sense of restriction and loss of guarantees in the request for justice, general principles, such as immediacy, must be present in all jurisdictional instances in their practical dimension. The iusphilosophical doctrine at this time, rather than dealing with the origin of the General Principles, leans more towards its effects in daily legal practice. Many of them are already in the form of legal norms, but unlike them, although the norm varies, therefore, their study always tends to be multidisciplinary.
