La crisis económica generada por la pandemia y la respuesta de los Estados y organizaciones supraestatales ha suscitado la apelación al papel activo del Estado con políticas calificadas como «no ortodoxas». Este trabajo pretende analizar su posible incidencia sobre la «Constitución económica» con la utilización del concepto de paradigma de Kuhn. A tal objeto, se estudia la regulación constitucional española y la de los Tratados de la Unión Europea y su Carta de Dere-chos Fundamentales. Ambas dibujan un mercado como ámbito de Derecho privado garantizado constitucionalmente y basado en la propiedad privada. Ello conduce a la conclusión de que no hay cambio de paradigma jurídico del mercado porque este solo se produce cuando un cambio social afecta a la propiedad privada y la garantía expropiatoria
The economic crisis generated by the pandemic and the response of the States and supra-state organizations has led to the appeal to the active role of the State with policies described as «non-orthodox». The present work aims to to analyze its possible impact on the «economic Constitution» with the use of the Kühn paradigm concept. To this end, the Spanish constitutio-nal regulation and the Treaties of the European Union and their Charter of Fundamental Rights are studied. Both draw a market as a field of constitutionally guaranteed private law, based on private property. This leads to the conclusion that there is no change in the legal paradigm of the market because it only occurs when a social change affects private property and the expro-priation guarantee
