Independencia, estado de derecho y autonomía regional

    Durante la fase de la independencia de la República de Colombia y de la antigua Nueva Granada, la idea de un nuevo modelo de Estado, estuvo al orden del día. No es cierto que el modelo de Estado que se montó en América independentista fuese copiado de Europa, por el contrario, América, esmadre del modelo federalista, una gran invención de la política moderna, entre otros aportes al  constitucionalismo moderno.América, también es madre de una teoría igualitaria –material de los derechos humanos–, incluyente de negros y de esclavos, distinta al formalismo francés que solamente tenía como sujetos dederechos a los blancos de cierta posición social. Asimismo, en América en particular en la vieja República de Colombia del siglo XIX, desintegrada luego, es madre de la idea del Estado de Derecho, intervencionista con énfasis en los débiles. Al frente de la construcción de un nuevo constitucionalismo y de un nuevo modelo de Estado de Derecho, intervencionista, autonomista y protector de los débiles con un criterio igualitario, realista y justo, no se puede soslayar la presencia del pensamiento democrático de  Simón Bolívar. Bolívar,es ante todo un ilustrado moderno, pero ilustrado moderno americano-español con una fuerza de pensamiento social y humanístico.Revelar la importancia de Bolívar y su aporte es el objeto de este ensayo.

    During the independence of the Republic of Colombia and the former Nueva Granada, the idea of a new model of state, was on the agenda. It is not true that the state model taken on American independence was a model copied from Europe, by contrast, America is the mother of the federalist mode, a great invention of modern politics, among other contributions to modern constitutionalism.America is also the mother of an egalitarian theory –human rights material–, inclusive of blacks and slaves, different from the French formalism that only had as subjects of rights the whites of a certain social standing. Also in America, particularly in the old Republic of Colombia in the nineteenth century, then disintegrated, is the mother of the idea of the State of Law, with emphasis on the weak.In front of the building of a new constitutionalism and a new model of State of Law, interventional, autonomous and protector of the weak with a realistic and fair egalitarian approach, you can not ig-nore the presence of democratic thought of Simon Bolivar. Bolivar, is primarily a modern illustrated but also American-Spanish with a force of social and humanistic thought.Revealing the importance of Bolivar and his contribution is the subject of this essay
