  Cuando se piensa en una decisión judicial sobre el estado de adoptabilidad de un niño, se pretende que la resolución, sea la correcta, ello a favor del niño al considerar su interés superior. En consecuencia, no solo se debe tener en cuenta la situación particular del niño, niña y adolescente, sino también la normativa convencional de derechos humanos y las normas nacionales, que permite establecer la fundamentación discursiva de la resolución que pueda ser tomada por el órgano jurisdiccional.

  When thinking about a judicial decision on the adoptability status of a child, the resolution is intended to be the correct, in favor of the child considering its best interest. Consequently, not only must the particular situation of the child and adolescent be taken into account, but also the conventional human rights norms and national norms, which allow establishing the discursive foundation of the resolution that can be taken by the court.
