    El presente ensayo reúne el tratamiento de dos etapas esenciales del desarrollo práctico del derecho notarial -totalmente alejadas en el tiempo-, dándoles un tratamiento similar. Por un lado, el nacimiento de la ciencia notarial, hace más de ochocientos años, tal cual hoy la conocemos y aceptamos, y por el otro, la descripción del derecho documental proyectada en el vigente Código Civil y Comercial de la Nación. Resulta por demás relevante advertir como la función notarial se mantiene incólume a través de los siglos, lo que viene a justificar claramente la recepción de instituciones clásicas y tradicionales en el moderno -e innovador- derecho codificado argentino actual.

    The present essay brings together the treatment of two essential stages of the practical development of notarial law, -totally distant in time-, giving them a similar treatment. On the one hand, the birth of notarial science, more than eight hundred years ago -as we know and accept it today- and on the other, the description of documentary law projected in the current Civil and Commercial Code of La Nación. It is also relevant to note how the notarial function has remained unscathed through the centuries, which clearly justifies the reception of classical and traditional institutions in the modern -and innovative- current Argentine codified law.
