Since the part-time work contract arose, the existence of a great problem was evidenced because the Social Security system was designed for a type of permanent and full-time hiring and the reduction of working hours implicitly reduced the contributions, therefore, had repercussions on the social protection that said system could offer to the workers who maintained this contractual relationship. Currently there are still doubts about key aspects of the social protection of this professional group. Doubts, mainly related to the principle of equality, which have been resolved at the jurisprudential level, which has had an impact on the continuous changes that the legislation that regulates this type of contract has undergone. In this study we will focus on the contributory retirement benefit and its modification as a result of the judgments of the Court of Justice of the European Union and our Constitutional Court.
