  Es este un comentario sobre la controversia suscitada alrededor del complemento sobre las pensiones contributivas que se contiene en el art. 60.1 del RDL 8/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley General de la Seguridad Social (LGSS). Más concretamente, comentaremos la particular causa que el Legislador invocó para extender el derecho a este complemento exclusivamente a las mujeres y la forma en la que tal discriminación ha sido reprobada por el Tribunal de Justicia de la Unión Europea en un pronunciamiento controvertido, cuyas consecuencias sobre el ordenamiento jurídico español tratamos de descifrar.

  This is a comment on the controversy raised around the supplement on contributory pensions contained in the article 60.1 of the Royal Legislative Decree 8/2015, of 30 October, approving the restated text of the General Social Security Act. More specifically, we will comment on the particular cause that the Legislator invoked to extend the right to this supplement exclusively to women and the way in which such justification has been rejected by the Superior Court of Justice of the European Union in a controversial ruling, and whose consequences on the Spanish legal system we try to decipher.
