  A irradiação dos Direitos Fundamentais, individuais e sociais, causada pela evolução do Estado Liberal de Direito para o Estado de Direito Social, sempre motiva a necessidade de reforçar o ideal constitucionalista de tornar cada vez mais eficazes os direitos instituídos na Constituição Federal de (1988) do Brasil. É refletindo sobre os Direitos Fundamentais, individuais e sociais, que este artigo objetiva reforçar a importância de serem preservadas as garantias e liberdades constitucionais para uma Dignidade Humana plena, cujo dever de preservação e defesa compete ao Estado perseguir, com a aplicação de todos os seus meios e recursos principalmente sobre a área que mais avilta o indivíduo, o Processo Penal.

  The irradiation of individual and social rights caused by the evolution of the Liberal State of Law to the Social State of Law always motivates the need to reinforce the constitutionalist ideal of making each more effective the rights established in the Federal Constitution of 1988 of Brazil. It is reflecting on individual and social fundamental rights that this article aims to reinforce the importance of preserving the constitutional guarantees and freedoms for a full human dignity, whose duty of preservation and defense is the responsibility of the State to pursue, with the application of all its means and resources mainly on the area that most demeans the individual, the criminal process.
