The Supreme Court Judgement (STS) 241/2013, of 9 May of the First Chamber Plenary, constitutes a fundamental milestone that puts an end to the debate on the legality or illegality of the «floor clauses» in the loans secured by a mortgage, by establishing that they can be subject, not only to a control of incorporation, understood in the sense of clarity of its text, but also to a specific control of transparency —or actual comprehensibility by the consumer of the burden accepted under the contract—. This work analyzes the main issues that arise in the Mercantile Courts in those processes that deal with the invalidation of this clause
