El presente trabajo pretende contrastar el concepto de violencia y acoso en el trabajo establecido por la nueva normativa de la OIT (Convenio n.º 190 y la Recomendación n.º 206) con el estado actual de la cuestión a nivel internacional, comunitario y nacional, tomando en este último caso como referencia el ordenamiento laboral español. En este sentido, el objetivo es verificar qué supone de novedoso y si supone una ampliación real en cuanto a las conductas prohibidas y los sujetos protegidos, sobre los que se desplegará la acción preventiva, sancionadora y reparadora que contempla el Convenio n.º 190 OIT, si llega a ser ratificado por los Estados miembros. Ello requiere una revisión previa del marco normativo y, con posterioridad, una exégesis de los preceptos de la nueva normativa de la OIT que delimitan su ámbito de aplicación.
This paper intends to contrast the concept of violence and harassment at work established by the new ILO regulation (Convention No. 190 and Recommendation No. 206) with the current state of affairs at international, European and national levels, taking in this last case as reference the Spanish labour law. In this sense, the objective is to verify what is new and if it represents a real extension in terms of prohibited behaviours and protected subjects, on which the preventive, sanctioning and reparative action contemplated in ILO Convention will be deployed, if it becomes ratified by the member states. This requires a prior review of the regulatory framework and, subsequently, an exegesis of the precepts of the new ILO regulations that define its scope.
