La Teoría General del Delito se ha ocupado tradicionalmente del estudio completo de los tipos penales mediante la exégesis de los mismos. En particular, alcanzan especial relevancia por su dificultad los controvertidos elementos subjetivos del injusto. Su análisis en Derecho Penal ha hecho correr ríos de tinta, resultando interesante trasladar su debate al ámbito penal militar mediante la valoración de los delitos castrenses. Esta publicación se centrará en la investigación del artículo 36 del Código Penal Militar, comprendido en el Capítulo VIII, del Título I, Libro II.

The General Theory of Crime has traditionally been focused on the thorough study of criminal legal types by its detailed analysis. In particular, the controversial subjective elements of the unjust attain special relevance due to its difficulty. Its analysis in Criminal Law has been hotly debated; which makes it interesting to move its debate to the scope of the Military Criminal Law by analyzing the crimes. This paper will focus on article 36 established in the Military Criminal Code, regulated within Chapter VIII, of Title I, Book II.
