La necesidad de vivienda, unido a la cantidad de inmuebles existentes en nuestro país deshabitados, ha provocado que las CCAA, en el ejercicio de su competencia en materia de vivienda, hayan aprobado en los últimos años regulaciones que, al amparo de la función social de la propiedad, limitan este derecho hasta niveles hasta ahora desconocidos. Por ello, es necesario determinar si las soluciones adoptadas pueden suponer una restricción de tal calibre que supongan, más que la conformación del derecho de propiedad, la alteración de su sustancia hasta convertirse en un derecho diferente. Vamos a analizar en este trabajo las normativas autonómicas y los pronunciamientos del TC sobre las mismas, con el fin de determinar el extremo antes mencionado.

Need for housing with the number of uninhabited properties in our country, has caused the Autonomous Communities, in the exercise of their competence in matters of housing, to have approved in recent years regulations that, under the protection of the social function of ownership, limit this right to previously unknown levels. For this reason, it is necessary to determine whether the solutions adopted may suppose such a restriction that they involve, rather than the formation of the property right, the alteration of its substance until it becomes a different right. We are going to analyze in this work the regional regulations and the pronouncements of the Constitutional Court on them, in order to determine the aforementioned point.
