Resumen de Insumos para comprender la justicia transicional y su aplicación: caso colombiano

  En Colombia, se aplicará un modelo de Justicia Transicional con parámetros de Justicia Restaurativa1, se buscar sancionar los crímenes y atrocidades cometidas en el marco del Conflicto Armado, catalogado por la Corte Constitucional (Sala plena, SU 1150, 2000) como la peor catástrofe humanitaria de occidente.

  En este orden de ideas, quien se encargará de esta tarea será el recién creado Tribunal para la paz, y es aquí cuando se habla por parte de la opinión pública de amnistías e impunidad llegando incluso a ganar el NO en el plebiscito por los acuerdos de paz con las FARC en el año 2016, se afirma que la Justicia Especial para la Paz no va a sancionar a los victimarios, pretendiendo simplemente olvidar lo sucedido en el conflicto. En este sentido el presente artículo da explicación a la justicia transicional y evalúa qué tipo de ganancia se obtiene al aplicar este modelo estudiando sus características, observa el contexto de violencia de Colombia, lo anterior a fin de obtener de comprender la justicia transicional y determinar si es necesaria su aplicación todo a fin reparar las Victimas2 del Conflicto del caso Colombiano.

  In Colombia, a model of Transitional Justice will be applied with parameters of Restorative Justice, seeking to sanction the crimes and atrocities committed in the framework of the Armed Conflict, cataloged by the Constitutional Court (Sala plena, SU 1150, 2000) as the worst humanitarian catastrophe from the west.

  In this order of ideas, who will be responsible for this task will be the newly created Court for peace, and this is where public opinion speaks of amnesties and impunity, even winning the NO vote in the plebiscite on the agreements peace with the FARC in 2016, it is affirmed that the Special Justice for Peace will not sanction the victimizers, simply pretending to forget what happened in the conflict. In this sense, this article gives an explanation to transitional justice and assesses what type of gain is obtained by applying this model by studying its characteristics, observes the Colombian context of violence, the foregoing in order to obtain an understanding of transitional justice and determine if its application is necessary in order to repair the Victims of the Colombian Case Conflict.
