Il whistleblowing nell'ordinamento italiano: quadro attuale e prospettive per il prossimo futuro

    La necessità di adeguare la normativa nazionale sul whistleblowing alla Direttiva europea in materia, recentemente approvata, rappresenta un'occasione preziosa per riflettere sul ruolo che potrebbe assumere tale strumento nel nostro ordinamento. Gli innegabili costi che un indiscriminato utilizzo del whistleblowing generano, sul piano della compressione dei 'controinteressi' meritevoli di tutela, inducono a suggerirne un uso cauto, limitato cioè alle sole ipotesi nelle quali esso può realmente essere finalizzato alla tutela di un interesse pubblico: ciò peraltro potrebbe anche contribuire a vincere le resistenze culturali che hanno sino ad ora ostacolato un'effettiva valorizzazione del whistleblowing come strumento di promozione della legalità nei luoghi di lavoro.

    The need to adapt the national Legislation on whistleblowing to the recently approved European Directive offers a valuable opportunity to reflect on the role that it could play in the Italian legal system. The undeniable costs of an indiscriminate use of whistleblowing, in terms of compressing the 'counter-interests' that are worthy of protection, suggest limiting its use to those cases in which it can really be aimed at protecting a public interest. This could also help to overcome the cultural resistance that has, so far, prevented its effective implementation as an instrument for promoting legality at the workplace.
