The Spanish legal system offers various possibilities and mechanisms for the resolution of disputes that may arise within the market, and therefore should include those disputes arising from conduct that may be reprehensible for their possible disloyalty, which at first were treated preferentially from the perspective of the civil procedural system.Currently, the evolution of the institution of arbitration at the continental level makes this figure an effective alternative for the resolution of conflicts derived from commercial laws, among them, those behaviors in which the contractual illicit brings the cause of the disloyalty of the Article 14 Unfair Competition Law, within the relational triangle that emerges from it, thus extending the scope of arbitration, after the Mitsubishi case, to matters of Public and quasi-criminal law.
