    With the Cadice della crisi di impresa e dell'insolvenza, the crisis finds its own definition for the first time at the regulatory level, like insolvency, which finds definition in the Legge Fallimentare and also applies in the coeval Cadice Civile. The crisis, in addition to acquiring its own semantic identity, becomes the pivot around which the new Crisis Code is built, the aim of which is to prevent and avoid insolvency and, only secondarily, to discipline it.

    In order to make this objective possible, the Crisis Code introduces new tools aimed at promptly highlighting the corporate crisis and seeking the most suitable measures for its composition, such as alert procedures and assisted settlement of the crisis. The measure of diligence required of the entrepreneur and of the other subjects participating in the regulation of the crisis is thus extended, imposing on the former new organizational obligations and on the qualified subjects reporting obligations for the indications of crisis, accompanied by a specific sanctioning system aimed at making effective the new tools provided by the Code.
