En el presente trabajo el autor ha querido poner de manifiesto la relación entre laudo y sentencia judicial, para ello indaga sobre el significado que el Tribunal Constitucional español atribuye al arbitraje como equivalente jurisdiccional; entendiendo esta expresión no como identidad absoluta o igualdad entre arbitraje y proceso judicial, o entre arbitro y juez sino como conjunto de garantías mínimas que debe reunir la institución para que sea un coadyuvante de la justicia en paridad con la jurisdicción del Estado. Esto obliga a encontrar la conexión finalista entre laudo y sentencia judicial y los criterios diferenciales entre uno y otra.

In the present work, the author wanted to highlight the relationship between the award and judicial sentence, for it inquires about the meaning that the Spanish Constitutional Court attributes to arbitration as a jurisdictional equivalent; understanding this expression not as absolute identity or equality between arbitration and judicial process, or between arbitrator and judge but as a set of minimum guarantees that the institution to be an aid to justice in parity with the jurisdiction of the State. This forces to find the finalist connection between award and judicial sentence and the differential criteria between one and the other.
