Este artículo analiza la forma en que se conjuga el derecho a la protección de los datos personales de salud con el derecho a la tutela efectiva en los procedimientos de responsabilidad patrimonial sanitaria, estudiando sus implicaciones y el conflicto que se presenta entre ambos derechos cuando no coincide la figura del reclamante con la del paciente.

This article analyzes the way in which the right to the protection of personal health data is combined with the right to effective protection in the proceedings of health patrimonial responsibility, studying its implications and the conflict that arises between both rights when they don´t coincide the figure of the claimant with that of the patient.
