Resumen de La Responsabilidad del Estado Colombiano por la falla en la detección temprana de enfermedades auditivas

El presente artículo presenta un análisis de la responsabilidad del Estado por la falla en la detección temprana de enfermedades auditivas, bajo el entendido de que le corresponde al Estado colombiano efectuar Potencial Evocado Automatizado de Tallo Cerebral (PEATC) a los recién nacidos dentro de las primeras 48 horas de su nacimiento a fin de establecer de forma acertada su audición y las enfermedades que pudiere presentar de acuerdo con lo establecido en la (L/982 de 2005), la falla del Estado por la omisión en la realización de este examen podría resultar en la perdida de una oportunidad para aquellos cuya detección temprana no se realizó impidiéndole acceder a un tratamiento que si bien no es una cura definitiva, resultaría en una ostensible mejora para su estilo de vida.

This article presents an analysis of the responsibility of the State for the failure in the early detection of auditory diseases, under the understanding that it is up to the Colombian State to effect Automated Brainstem Implicated Potential (ABB) to newborns within the first 48 hours after his birth in order to correctly establish his hearing and the diseases he may present in accordance with the provisions of Law 982 of 2005, the failure of the State to omit this test could result in the loss an opportunity for those whose early detection was not done, preventing them from accessing a treatment that, although it is not a definitive cure, would result in an obvious improvement in their lifestyle.
