    Con la aparición de la teoría del constitucionalismo contemporáneo, la nueva dogmática jurídica relacionada con la argumentación, la interpretación jurídica, el garantismo y el no positivismo principialista, ha ocasionado, que el derecho, tanto en la práctica como en la teoría, apunte hacia una nueva perspectiva lejos de la teoría tradicional positivista que por tanto tiempo rigió nuestra manera de entender y aplicar el derecho. El contenido de este trabajo trata de exponer la contribución de Riccardo Guastini a la teoría de la interpretación jurídica contemporánea, respondiendo en parte a esta transformación jurídica y a la impronta de la reforma constitucional de derechos humanos de junio de 2011 en México que ha venido a develar un nuevo lenguaje, así como la necesidad de adoptar novedosos métodos de interpretación para resolver casos esencialmente controvertidos en materia de derechos humanos.

    With the appearance of the theory of contemporary constitutionalism, the new legal dogmatics related to argumentation, legal interpretation, guaranteeism and non-positivism, has led the law, both in practice and in theory, to point a new perspective far from the traditional positivist theory that for so long governed our way of understanding and applying the law. The content of this work tries to expose the contribution of Riccardo Guastini to the theory of contemporary legal interpretation, responding in part to this legal transformation and to the imprint of the constitutional reform of human rights of June 2011 in Mexico that has come to unveil a new language, as well as the need to adopt novel methods of interpretation to resolve essentially controversial cases in the field of human rights.
