«Un dogma privo di solide fondamenta». L’efficacia retroattiva della divisione tra ritorno all’antico e prospettive attuali.

    Nel saggio si analizza una recente sentenza della Cassazione che proclama l’efficacia costitutiva degli atti di divisione contro l’opinione tradizionale che ne aveva riconosciuto la natura dichiarativa. Si esamina la genesi della precedente dottrina nell’ambito diritto feudale e se ne segue lo sviluppo, in contrasto con il diritto romano, fino alla disposizione dell’art.

    757 c.c. L’autore si sofferma, in particolare, sul tema della compatibilità dell’efficacia dichiarativa degli atti di divisione con l’efficacia retroattiva.

    The paper analyses a recent judgment of the Supreme Court of Cassation which states the nature of the division of the assets to be constitutive, in opposition to the traditional opinion that was used to proclaim them as declarative.

    The author examines the genesis of the declarative nature of the division deeds in the feudal law and follows the development of this principle in contrast with the Roman Law, until the rule of the art. 757 of the Italian civil Code, which orders to backdate the division, as if there had never been communion between the former co-owners.

    The essay highlights the compatibility of the declarative efficacy of the division deeds and their retroactive efficacy in the light of the Roman jurisprudence
