Actio aquae pluviae arcendae e sistemi di deflusso delle acque in età decemvirale

    The essay, which deals with the problem of the protection of crops from rainwater, already particularly felt by the first settlements in the territory that will later be in Rome, focuses on the remedies prepared for this purpose, and, thinking of these, reflects, in the specific, on the actio aquae pluviae arcendae, starting from the interpretation of the well-known passage of Digesta: Pomp. 7 ex Plaut. (D.40.7.21 pr.). So, after offering a summary of the main reconstructions presented in doctrine regarding the decemviral conformation of the remedy, the work draws the reader's attention first of all on the original characters of the action, and, among these, on the requirement of opus; then, on the preventive nature of the remedy. From this point of view, by embracing a thesis already of broad doctrinal consensus, and reasoning on the nature of the action, the essay ends up by endorsing the hypothesis that, originally, the a.a.p.a.

    represented a sanctioning tool against the hypothesis of alteration in peius of one of the aspects of the land structure, that linked to the rainwater runoff system. Only later did the remedy undergo progressive changes, of which precious testimony is offered by Pomponius. The veteres exploiting the semantic latency of the nocere of the decemviral norm, would have ended up considering sufficient damage, even for the purpose of the practicability of the actio de qua, to be damage.

    Il saggio, che si confronta con il problema della difesa delle colture dalle acque piovane, già particolarmente sentito dai primi insediamenti nel territorio che sarà poi dell’Urbe, si sofferma sui rimedi all’uopo predisposti, e, ragionando di questi, riflette, nello specifico, sull’actio aquae pluviae arcendae, partendo dall’interpretazione del noto passo dei Digesta: Pomp. 7 ex Plaut. (D.40.7.21 pr.). Quindi, dopo aver offerto una sintesi delle principali ricostruzioni prospettate in dottrina a proposito della conformazione decemvirale del rimedio, il lavoro richiama l’attenzione del lettore anzitutto sui caratteri originari dell’azione, e, tra questi, sul requisito dell’opus; poi, sul carattere preventivo del rimedio.

    Sotto tale profilo, sposando una tesi già di largo consenso dottrinale, e ragionando sulla natura dell’azione, il saggio finisce per avallare l’ipotesi che, originariamente, anche l’a.a.p.a. abbia rappresentato uno strumento sanzionatorio avverso le ipotesi di alterazione in peius di uno degli aspetti dell’assetto fondiario, quello legato al sistema di deflusso delle acque piovane. Solo successivamente il rimedio avrebbe subito delle progressive modifiche, di cui preziosa testimonianza è offerta da Pomponio. I veteres, sfruttando la latenza semantica del nocere della norma decemvirale, avrebbero finito per ritenere sufficiente, ai fini dell’esperibilità dell’actio de qua, un danno anche solo potenziale.
