Resumen de Acerca de la incidencia de los juicios penales paralelos en determinados derechos fundamentales del investigado

El tratamiento que se da en nuestro país a ciertos procesos penales genera en ocasiones una vulneración grave y sistemática de los derechos fundamentales del justiciable —como el derecho a la presunción de inocencia, a la imparcialidad del juzgador, a un proceso justo, al honor, a la intimidad o el derecho a la propia imagen- así como de otros bienes e intereses jurídicos, dignos igualmente de protección. Siguiendo esta línea argumental se analizan las principales claves de la doctrina constitucional y de la jurisprudencia del Tribunal Supremo y del Tribunal Europeo de Derechos Humanos en relación al binomio libertad de expresión e información versus derecho a la presunción de inocencia, a un juez imparcial, a un proceso justo y al derecho al honor, a la intimidad y a la propia imagen; así como la debida limitación entre tales derechos y, finalmente, la cuestión relativa a la información veraz y el reportaje neutral.

About the incidence of parallel criminal trials in certain fundamental rights of the investigated. The treatment that is given in our country to certain criminal proceedings generates in many occasions a serious and systematic violation of the fundamental rights of the justiciable — such as the right to the presumption of innocence, to the impartiality of the judge, to a fair process, to honor, privacy or the right to self-image, as well as other legal assets and interests worthy of protection. Following this line of argument, the main keys of the constitutional doctrine and jurisprudence of the Supreme Court and the European Court of Human Rights related to the binomial freedom of expression and information and right to honor versus right to the presumption of innocence are analyzed. impartial judge and a fair trial; the reciprocal limitation between such rights and, finally, the issue of truthful information and neutral reporting.
