La inexistencia de un cuerpo legal sobre el teletrabajo en Argentina, y las regulaciones dictadas a raíz de la COVID-19, fueron determinantes para que el gobierno decidiera elaborar un proyecto que, finalmente, terminó siendo ley el 31 de julio de 2020 (Nº 27.555, promulgada por el decreto 673/2020, B.O., 14 de agosto de 2020). Entrará en vigor una vez cumplidos 90 días desde la finalización del “aislamiento social, preventivo y obligatorio”, impuesto por el Decreto de Necesidad y Urgencia (DNU) 297/2020. Una ley que si bien fue aprobada en la Cámara de Diputados por amplio margen (214 votos a favor, 29 abstenciones y 1 voto en contra), no sólo que no aconteció lo mismo en la Cámara de Senadores (40 votos a favor y 30 en contra), sino que ha merecido severas críticas del empresariado y de una parte de la doctrina científica.
The non-existence of a legal body on teleworking in Argentina, and the regulations dictated as a result of COVID-19, were decisive for the government to decide to develop a project that, finally, ended up being law on July 31, 2020 (No. 27.555, promulgated by decree 673/2020, BO, August 14, 2020). It will enter into force once 90 days have elapsed from the end of the "social, preventive and compulsory isolation", imposed by the Decree of Necessity and Urgency (DNU) 297/2020. A law that, although it was approved in the Chamber of Deputies by a wide margin (214 votes in favor, 29 abstentions and 1 negative vote), not only that the same did not happen in the Chamber of Senators (40 votes in favor and 30 negatives), but has deserved severe criticism from the business community and a part of the academic doctrine.
