    Se aborda un supuesto particular objeto de pronunciamiento judicial referido a una empresa que tramita un proceso de Despido colectivo a pesar de tener beneficios antes y después de abordar el proceso de reestructuración. Se analiza la obligación de la empresa de aportación al Tesoro Público que según el Organismo debe realizar por los trabajadores que acceden al desempleo, cuando el despido colectivo se ha tramitado entre la fecha de entrada en vigor de la norma que establece la obligación de aportación y la fecha retroactiva que la ley fija en su texto. Se determina, además, los efectos para la aportación de la discrepancia entre lo autorizado por la Resolución administrativa y los despidos que finalmente se materializan.

    It deals with a specific case that is the subject of a judicial pronouncement related to a company that is engaged in a collective redundancy process in spite of having made profits before and after addressing the restructuring process. The ruling deals with, among other issues, the obligation of the company to contribute to the Public Treasury that, according to the Public Body (SEPE), it has for those workers who become unemployed, when the collective dismissal has taken place between the date of entry into force of the regulation that establishes the obligation and the retroactive date that the law includes in its text. It also determines the effects of discrepancies between what is authorized by the administrative resolution and the dismissals that are finally carried out.
