    En el presente comentario se aborda la reciente Sentencia del Tribunal Supremo de 18 de junio de 2020 (rec. 893/2018), dictada en materia de extinción indemnizada del contrato de trabajo a instancias del trabajador, del artículo 50 apartado c) del Estatuto de los Trabajadores. En ella se reconoce el derecho del trabajador a instar la extinción de su contrato de trabajo cuando el empresario le abona parte de su retribución al margen de la nómina, con incumplimiento de su obligación de abonar las cotizaciones a la Seguridad Social. Dicha circunstancia se considera incumplimiento suficiente para pedir la extinción del contrato.

    This comment addresses the recent Spanish Supreme Court ruling of 18th June 2020 (rec. 893/2018), issued on the matter of termination of the employment contract at the request of the worker, according to article 50 c) of the Workers' Statute. It recognizes the right of the worker to urge the termination of the employment contract when the employer pays part of the salary outside of the payroll, in breach of the obligation to pay Social Security contributions. This circumstance is considered a sufficient breach to request the termination of the contract.
