    La controversia sobre la calificación jurídica de los repartidores de plataformas parece que ha sido finalmente resuelta por el Tribunal Supremo, en Pleno, declarando que la relación existente entre un repartidor y la empresa Glovo tiene naturaleza laboral. Se constata que concurren las notas definitorias del contrato de trabajo, en particular las de dependencia y ajenidad, declarando el Tribunal que la empresa Glovo no es una mera intermediaria en la contratación de servicios entre comercios, clientes y repartidores, sino que presta servicios fijando las condiciones esenciales para la prestación de dicho servicio, es titular de los medios esenciales para la realización de la actividad y se sirve de repartidores que no disponen de una organización empresarial propia y autónoma, los cuales prestan su servicio por cuenta de esta.

    The controversy over the legal qualification of platform distributors seems to have been finally resolved by the Supreme Court, in plenary session, declaring that the relationship between a distributor and the Glovo company is of a labour nature. It is verified that the defining notes of the employment contract concur, in particular those of dependency and "ajenidad", declaring the Court that the Glovo company is not a mere intermediary in the contracting of services between businesses, clients and distributors, but that it provides services by fixing the essential conditions for the provision of said service, it is the owner of the essential means to carry out the activity and uses distributors who do not have their own and autonomous business organization, who provide their service on their behalf.
