    En el presente artículo se estudia el régimen jurídico del derecho a la desconexión digital desde un ámbito tecno-laboral. El objetivo es plasmar la evolución del concepto, abordando un análisis previo de los principales pronunciamientos judiciales tanto en sede comunitaria como nacional que nos lleve al estudio pormenorizado del contenido de este “nuevo” derecho en la Ley Orgánica de Protección de Datos y garantía de los derechos digitales (LOPD). Además, y antes de hacer una valoración crítica al respecto, pondremos de relieve el impacto que ha causado el COVID-19 en los derechos fundamentales del trabajador al implantarse, en un contexto social de confinamiento como único remedio a la expansión del virus, esta modalidad del trabajo a distancia.

    This article studies the legal regime of the right to digital disconnection from a techno-labor sphere. The objective is to capture the evolution of the concept, addressing a prior analysis of the European and national main judicial pronouncements that leads us to a detailed study of the content of this “new” right in the Organic Law on Data Protection and guarantee of digital rights (LOPD). Furthermore, and before making a critical assessment in this regard, we will highlight the impact that COVID-19 has caused on the fundamental rights of the worker by implementing this modality, in a social context of confinement as the only remedy for the spread of the virus. from remote work.
