Herencias españolas en la protección del patrimonio documental en Cuba

    España conquistó y dominó a Cuba, una pequeña isla del Caribe, durante casi cuatro siglos. Desde 1578 se comprendió, desde la metrópolis, la necesitad de conservar los documentos que se generaban en la Colonia, como evidencias del actuar de la administración colonial y de los residentes en la Isla. Tanto es así, que desde ese año, se emitieron un grupo de normas jurídicas que marcan pautas hasta hoy en la Protección del Patrimonio Documental en Cuba. El objetivo esta ponencia es valorar las herencias españolas en la Protección del Patrimonio Documental en Cuba y cómo influyen o no en la identidad nacional. El autor resume, con un enfoque sistémico y una óptica jurídica, las disposiciones jurídicas emitidas por España durante su dominio sobre el archipiélago y las compara con la normativa vigente en país sobre la materia señalando las similitudes y fortalezas. Para logarlo se ha empleado, fundamentalmente, el método de análisis de documentos, que permitió la recopilación y estudio de las normas y el teórico-jurídico permitió fundamentar los presupuestos teóricos.

    Spain conquered and dominated Cuba, a small Caribbean island, for almost four centuries. Since 1578 it was understood, from the metropolis, the need to preserve the documents that were generated in the Colony, as evidences of the colonial administration and the residents of the Island. So much so, that since that year, a group of legal norms that mark guidelines to date in the Protection of Documentary Heritage in Cuba. The objective of this paper is to assess Spanish heritage in the Protection of Documentary Heritage in Cuba and how they influence or not the national identity. The author summarizes, with a systemic approach and a legal perspective, the legal dispositions issued by Spain during its dominion over the archipelago and compares them with the regulations in force in the country on the matter, pointing out the similarities and strengths. In order to achieve this, the document analysis method was fundamentally used, which allowed for the compilation and study of the norms and the theoretical-juridical allowed to base the theoretical assumptions.
