    Nello studio dell’attività probatoria l’attenzione della dottrina si è concentrata soprattutto sulle prove, ossia sugli elementi idonei ad entrare nel quadro decisorio, e sull’atto del provare, con particolare riguardo allo standard necessario per ritenere raggiunta la prova. È rimasto, invece, decisamente trascurato il terzo elemento di cui si compone l’operazione probatoria, vale a dire la proposizione da provare. Una maggiore attenzione a questo tema gioverebbe, ad avviso dell’autore, alla soluzione delle numerose incertezze che si riscontrano nell’individuazione degli oneri probatori e delle regole di giudizio da seguire in ogni alternativa decisoria.

    In the study of the probative activity, juridical doctrine has focused its attention especially on the evidence, i.e. the suitable elements to be placed in the framework of the decision, and on the act of proof, with special emphasis on the standard required to ascertain that necessary evidence is reached. On the contrary, the third element that constitutes the probative activity, i.e. the proposition to be proved, has remained decidedly neglected. According to this author, greater attention given to this third element would, instead, help to resolve the numerous uncertainties that are found in the identification of the burden of proof, and in the rules of judgement that must follow any alternative decision-making process.
