    Legislative decree 108/2017 – based on the indications of directive 41/2014/ EU – has established a double regulation for interceptions. In the first case, where assistance from another Member State is needed. In the second, where, for the purpose of carrying out an investigative measure, the interception of telecommunications is authorized by the competent authority of a Member State and the communication address of the object of the interception specified in the interception order is used in the territory of another Member State from which technical assistance is not necessary to transport to the interception; the interceptor Member State must provide to notify the interception to the competent authority of the Member State in whose territory the intercepted subject is located.

    Il d.lg. n. 108/2017 – sulla base delle indicazioni della direttiva 41/2014/UE – ha previsto una duplice disciplina per le intercettazioni. Nel primo caso, ove sia necessaria l’assistenza di un altro Stato membro. Nel secondo, laddove, ai fini dell’esecuzione di una misura investigativa, l’intercettazione delle telecomunicazioni è autorizzata dall’autorità competente di uno Stato membro e l’indirizzo di comunicazione dell’oggetto dell’intercettazione specificato nell’ordine di intercettazione sia utilizzato sul territorio di un altro Stato membro dal quale non è necessaria l’assistenza tecnica per trasportare all’intercettazione; lo Stato membro intercettore deve provvedere a notificare l’intercettazione all’autorità competente dello Stato membro sul cui territorio si trova il soggetto intercettato.
