    The paper analyses the dynamics of the European Investigation Order in criminal matters with a view in the balancing of the opposite needs for efficiency and respect for guarantees, with a specificregard to the system of appeals, especially as executing State, whereby the unquestionable reasons of the merit underlying the investigation order must combine with the requirement of proportionality and non-opposition to the fundamental rights.

    Il contributo ricostruisce le dinamiche applicative dell’ordine europeo di indagine penale nella prospettiva del bilanciamento tra le contrapposte esigenze di efficienza e di rispetto delle garanzie, con attenzione specifica al sistema delle impugnazioni, specialmente nella procedura passiva, dove la insindacabilità delle ragioni di merito sottese all’ordine di indagine si deve coniugare con il requisito della proporzionalità e della non contrarietà ai diritti fondamentali.
