L’articolo si sofferma sulla applicazione della clausola di non punibilità per particolare tenuità del fatto ex art. 131-bis c.p. all’ente quale conseguenza diretta e automatica del riconoscimento della scusante in capo alla persona fisica autore del reato. La Corte, nelle due sentenze riportate e tra loro conformi, ha escluso l’automatica estensione della non punibilità per particolare tenuità del fatto riconoscendo valore generale al principio di autonomia della responsabilità dell’ente ex art. 8 d.lg. n. 231/2001 e a ragione della natura di “criptocondanna” del conseguente proscioglimento.
This article focuses on two cases decided by the Italian Supreme Court of Cassation dealing with the extension to the corporations of the provision set out in Article 131-bis of Italian Penal Code excluding the liability of the individual in case that the committed crime is not particularly harmful. After having stated that a company could still be prosecuted according to Article 8 of the Law Decree no 231/2001 in case a corporate officer is acquitted under the discussed Article 131-bis for the committed crime, the Supreme Court has affirmed, in both cases, that this judicial decision pronounced in favour of the individual is substantially a “hidden conviction” that consequently cannot be extended automatically in the proceedings against the entity. This claim is bolstered by the conside- ration that according to the above mentioned Article 8 the company’s liability should be independent of the liability of individuals.
