Resumen de Sobre el futuro de los tribunales económico-administrativos

A pesar de que el Tribunal de Justicia de la UE ha declarado que los tribunales económico-administrativos no tienen legitimación para plantearle cuestiones prejudiciales por carecer dichos órganos de autonomía e imparcialidad respecto de la Administración tributaria, la Comisión Europea basándose en el dogma (más teórico que real en la práctica) de la obligación que tiene cualquier órgano administrativo de inaplicar el derecho nacional contrario al europeo, entiende que no existen razones contrarias a que dichos tribunales continúen tutelando, previo a la vía judicial, la aplicación del Derecho de la UE.

Despite the fact that the Court of Justice of the EU has declared that the economic-administrative courts do not have the legitimacy to raise questions for preliminary rulings due to the lack of autonomy and impartiality with respect to the tax administration, the European Commission based on the dogma (more theoretical that real in practice) of the obligation that any administrative body has to not apply national law contrary to the European one, it understands that there are no reasons to the contrary that said courts continue to protect, prior to judicial means, the application of EU law.
