La cuestión a dilucidar en este caso se centra en el papel que desempeña la plataforma colaborativa Airbnb en la contratación de alojamientos turísticos. Para ser más exactos, la disyuntiva que ha de resolver el Tribunal de Justicia de la Unión Europea es si Airbnb realiza una mera actividad de intermediación entre el oferente y el usuario del alojamiento o si va más allá de ser una simple intermediaria y presta, además, el servicio subyacente de alojamiento turístico. La cuestión no es baladí, dada la repercusión que implica en cuanto a la normativa que resulta aplicable a la citada plataforma.

The issue to be clarified in this case focuses on the role played by the Airbnb collaborative platform in the contracting of lodgings for tourists. To be more precise, the question to be decided by the Court of Justice of the European Union is whether Airbnb is merely an intermediary between the lodging provider and the user of the lodging or whether it goes beyond being a mere intermediary and provides, in addition, the underlying lodgings service for tourists. The question is not trivial, given the impact it has on the applicable rules for the said platform.
