El derecho a la educación: sus brechas de justicia, conciencia y género

  En este trabajo analizo el derecho a la educación en su dimensión ideológica y como instrumento al servicio de la dignidad, la igualdad, la diferencia, el pluralismo y los derechos en un contexto garantista, y cómo se enfrenta, entre otros, a dos serios problemas que merecen toda la atención iusfilosófica crítica: la objeción ideológica paterna a los contenidos de las asignaturas, y la segregación o separación de los y las estudiantes en función de su sexo biológico. El desarrollo argumentativo del análisis tiene permanentemente a la vista el desarrollo iuspositivo normativo y jurisdiccional de las dos cuestiones señaladas y las últimas manifestaciones al respecto del TC español.

  In this work I analyze the right to education in its ideological dimension and as an instrument at the service of dignity, equality, the difference, the pluralism and rights in a guarantee context, and that faces, among others, two serious problems that deserve all the critical iusphilosophical attention: the parental ideological objection to the contents of the subjects; and the segregation or separation of the students according to their biological sex. The argumentative development of the analysis has permanently present the normative and jurisdictional tax development of the two issues indicated and the latest statements regarding the Spanish TC.
