  El presente artículo de Moritz Vormbaum, precedido de una nota de Miguel Ángel Cano, trata de la vida e influencia de uno de los grandes penalistas del siglo XX, Eberhard Schmidt. Vormbaum analiza el dudoso papel que Schmidt jugó durante la etapa del Nacionalsocialismo, así como la ausencia de (auto)crítica tras el fin de la Segunda Guerra Mundial.   This paper by Moritz Vormbaum, preceded by a note by Miguel Ángel Cano, deals with the life and influence of one of the great jurists in the field of criminal law of the 20th century, Eberhard Schmidt. Vormbaum analyzes the dubious role that Schmidt played during the period of National Socialism, as well as the absence of (self) criticism after the end of the Second World War. The work confirms that the debate in Germany around the murky national-social-list past of certain jurists, some of whom have marked the scholarly evolution of German criminal law in the last seventy-five years, is far from being closed.
