Resumen de A fórmula Barroso e as frágeis fundações do (neo)constitucionalismo

The article intends to go through the conceptual foundations of Brazilian neoconstitutionalism based on the writings of constitutionalist Luis Roberto Barroso. In this way, it is possible to verify a fragile conceptual support of this current based on an error in the reading of the German legal tradition. To justify this assertion, the writings of the new German school of civil law, the history of law and especially the writings of Michael Stolleis on the subject are used. In closing, the consequences of this false starting point for the division of powers and the consolidation of democracy in the rule of law are pointed out.

O artigo pretende percorrer as fundações conceituais do neoconstitucionalismo brasileiro partindo dos escritos do constitucionalista Luís Roberto Barroso. Com isso, constata-se uma frágil sustentação conceitual dessa corrente assentada num erro de leitura da tradição jurídica alemã. Para justificar essa assertiva, recorre-se aos escritos da nova escola de Direito Civil alemã, História do Direito e especialmente dos escritos de Michael Stolleis sobre o assunto. No fechamento, apontam- se as consequências desse ponto de partida falso para a divisão de poderes e a consolidação da democracia no Estado de Direito.
